Continuing Care retrospective reviews to be scrapped

The Continuing Care retrospective review process is to be closed, Following discussions with the Health Service Ombudsman, David Nicholson has written to NHS colleagues, to inform them that the retrospective review process for continuing care, started after the Ombudsman’s report in 2004, should be drawn to a close. New pre 2004 cases should be submitted to SHA’s by 30 November 2007 or else they will not be considered unless there are “exceptional circumstances”. Accordingly anyone who feels that they or their relative have been denied NHS continuing care in the past and would like that decision reviewed needs to progress the retrospective review application as a matter of urgency.

The NHS continuing care (responsibilities directions 2007) the National Framework for NHS Continuing Health and NHS Funded Nursing Care was issued as best practice guidance in June 2007. These directions make compliance with that guidance mandatory with effect from 1st October 2007. The full text of the directions can be downloaded here.
