In
1999 the Coughlan case gave rise to the assertion that those whose
principal need was for nursing care should receive that free under the NHS.
Following
Coughlan directions were issued for Health Trusts to review their
criteria for accepting patients under the NHS, whether in private nursing
homes or otherwise, and to ensure they were not applying these too
narrowly. The Trusts were told to go back and review the cases that they
had considered and refused previously to ensure they had done the job
properly.
I wrote an article on Coughlan some time ago following which I
received a stream of emails from people whose relatives were caught up in
a battle over NHS funding.
No Win - No Fee
Relevant
in certain cases is our "No win – No fee" service:

RESTITUTION
If a
family member has been in care for some time and had to pay the fees
themselves we can, in the right cases, reclaim those losses from the
State. This is called "restitution".
The
job involves proving that the patient’s main need for care was, from a
certain point in time, a health need. We can do this by examining the
medical records.
We
have successfully claimed tens of thousands of pounds for families
together with interest and some case histories are on our
website. Click here
to see them. - Case Histories
We will initially assess the merits of the case
in conjunction with our Professor of Nursing and, if it passes the test,
take the case on either on a no win-no fee basis or Capped Fee
Scheme – the choice is yours.
