Robert Campbell &
Company obtain offer of £270,000.00 Continuing NHS Care fees
restitution.
In 2007 I was appointed Receiver for a Mr
Rowland. As I looked after his affairs it became apparent to me that
the £50,000.00 pa+ that he was having to pay in nursing home fees
might actually be payable by the NHS as his main need for care was a
health need.
As I am not an expert in this area I
researched and found Robert Campbell & Company a solicitors firm
specialising nationally in healthcare law.
Robert Campbell & Company battled with
the NHS body responsible for some 49 months sometimes having to
chase reminder after reminder but they never let the pressure slip.
Ultimately they were able to elicit an
offer of £270,000.00 by way of restitution, which is absolutely
fantastic.
Robert Campbell & Company have been on
the ball and we have worked so well together. I am very proud of
this achievement and would not hesitate in recommending Robert
Campbell & Company’s services for people in similar
situations. They are the best.

The family of Jack have "justice" for
their dad, now sadly departed, in the form of £28,000 settlement
cheque. Jack’s son Richard said:

finally settled and wish to thank you all for your perseverance and
hard work over the last 18 months."

Re: Continuing NHS care funding for mum
Myself and Mick, my brother are extremely grateful
for the service you have provided, for us, with limited
knowledge of the system, am sure we would have received little
fairness from the powers that be. Maybe I'm being cynical, but from
what I've seen and learnt over the last few years, and from people
in the same boat who have not contested care fees, this has been my
experience. I know both me and Mick recommend your services to all
we meet who we feel would benefit from them.
thanks and regards

| Re: Mrs PM (Deceased)
I am writing to inform you that I am now the proud
owner of a cheque from the Leeds PCT to the value of £43,334.00.
What a Christmas present!
I have been involved with Carers Leeds for many
years and they were aware of the problems with the PCT. I have given
them your name and web address for their records. They deal with so
many people in different situations. Your help may become as
invaluable to someone else as it has been to myself.
As promised I am enclosing a comment for your
website.
"I am very grateful to Robert Campbell for the
professional input in this highly complex and specialist area.
Robert arranged for professional representation together with an
expert from the medical profession to accompany me to the IRP
meeting. The experts dealt with areas, which I would never have even
considered. I am convinced that without the specialist input of
Robert and his team I would not have achieved such a successful
outcome."
I hope this comment is the type of quote, which is
useful.
Kind regards, and a Happy New Year,
PM

"In 2008, my mother was suffering from
Alzheimer's disease, vascular dementia, and a certain amount of
brain damage as a result of an aneurism, She was 67 years of age at
that time.
We arranged for mum to be admitted to a residential
home specialising in Alzheimer's cases as my mother was deemed by
social services to be unsafe at home, and had been moved to a
dementia ward after an operation. Although she was not in a nursing
home, I felt that she was entitled to continuing NHS care funding
due to the nature of her illness and the intensity of care she
required in order to avoid further accidents and injuries.
I researched into the matter and found a specialist
firm of solicitors, Robert Campbell & Co, who initially did a
free online assessment for us and subsequently took the case
on.
After a battle lasting two years, I am delighted to
say Robert Campbell & Co have secured NHS continuing care
funding for mum at a saving of some £30,000 per annum.
I am absolutely delighted at the result and the
service that we have received from Robert Campbell & Co and I
would highly recommend their services to any families in a similar
position."

| Rob,
hopefully by now you have received the letter confirming that our
appeal for Continuing Healthcare Funding has been agreed and that
the NHS will continue paying Elsie’s fees. This is a really
good victory and I would just like to thank you for your help in
winning this case.

Re:
Continuing Care Application
"I have been very pleased with the way in which you have
conducted the case and with the eventual successful outcome, belated
though it has been. There is no doubt in my mind that without your
efforts and those of your expert nursing consultant, my mother and
father would have lost their house and savings. My father would also
have become extremely distressed and unwell at such an unfair
outcome though, thankfully, my mother would never have known. You
have prevented a great injustice and for that I cannot thank you
enough.
Many thanks.

Chris and Lynn Leeds wanted us to share
with others in similar situations their experience of working with
us and (not being shrinking violets) we agreed!
Here’s a letter from Chris to one of our
other prospective clients:
Dear Sarah,
First of all my sympathy for your plight. I
know how difficult and distressing it is to have someone close to
you suffering from Alzheimers Disease, even without the bureaucratic
hurdles.
My father has been suffering from
Alzheimers for several years. In December 2006, he went into
hospital for an unrelated condition, but could not return home
because of his Alzheimers. My sister and I came under considerable
pressure to remove him from hospital. We refused, despite open
threats, on the grounds that they had not provided a continuing care
assessment that would have concluded whether or not he was eligible
for NHS Continuing Care and in any event what care he required.
Eventually we got this assessment. It was woefully inadequate and we
challenged it. Over the following months, we were pressured and
threatened and when we stood firm they produced further assessments
that contradicted the others.
By late 2007, my father was still in
hospital and it was clear that we had reached the limit of what my
sister and I could achieve on our own. We concluded that we had a
choice of giving up and being dissatisfied that we had not done the
best for our father and allowed the NHS to get away with breaching
its own rules or we could employ a lawyer to look after our
interests. We decided on the latter course. A work colleague of mine
had used Rob for a similar case and highly recommended him.
Right from the beginning, we found Rob
knowledgeable, focussed, available and good to deal with. The first
thing he did was take on all the contact with the NHS that we were
finding very wearing. It was clear that they both respected and
feared him. We felt that Rob had our father's case in hand at all
times. Sometimes, we didn't hear from him for a while, but when
something was needed there he was without any prompting from us.
In January 2007, after Rob had been dealing
with our father's case for only 2-3 months, the NHS caved in and
granted our father NHS Continuing Care. There was then a dispute
about where he was to be placed that again Rob handled successfully
on our behalf. Finally, last summer the NHS decided to review the
case. Rob arranged for a top notch nurse assessor to do an
assessment on our father's behalf and to keep the NHS's own
assessment honest. Again, the NHS concluded that our father remained
eligible. I do not believe any of these favourable outcomes would
have been likely without Rob being on our side.
If you ask Rob to work for you it will cost
some money. However, in our experience it was worth every penny and
saved a considerably larger sum, as well as giving us the
satisfaction of fighting something where right was on our side and
our father's side and winning that fight.
I have absolutely no hesitation at all in
saying that I would recommend Rob's services to anyone.
Best wishes,
Chris

Re: Application for NHS continuing care funding.
Our father was discharged from hospital
into a private nursing home at the cost of some £30,000.00 per
annum. The NHS refused to take responsibility for this, which he was
having to pay himself
The family believed that dad’s care ought
to be the responsibility of the NHS as his main need for care was in
our view undoubtedly a health need although of course he also needed
looking after generally.
We therefore instructed specialist
solicitor Robert Campbell of Robert Campbell & Company to pursue
the matter under his firm’s capped fee scheme. We first undertook
a free on-line assessment and the outcome was encouraging. We then
provided Robert with all the necessary information and he took up
the battle for us.
I am delighted to say that Robert Campbell
and Company’ skill and expertise have won the day for us and the
NHS have now accepted the responsibility for dad’s care fees. The
family feel themselves very lucky to have found a firm of Robert
Campbell and Company’ calibre to assist them in this highly
complex and specialist area and would recommend them unreservedly to
others in similar situations. We are most grateful for an important
job well done!

invaluable. Because of the complexity of the case, a decision was
made to instruct Mr Robert Campbell, those instructions were given
